  ONLINE SERVICES AGREEMENT This agreement governs your use of Online Access through the Internet. As used herein, "ACA" means Louisiana Ag Credit ACA. By using Online Access, you agree to the following: 1. Subject to the terms of this agreement, ACA hereby grants you online access to your account, for the purpose of viewing that account information which you are authorized to receive, and for such other uses as ACA may make available to you from time to time. You are the only user of this service authorized under this agreement. You agree to keep confidential and not publish, broadcast, retransmit, modify, commercially exploit, or otherwise disseminate the data, information, or services provided under this agreement. You shall be responsible for the confidentiality and use of your user id, PIN and other security data, methods and devices. You understand that you shall be solely responsible for the use of any data, information, or services obtained using your user id, PIN or other security data. 2. You agree that Online Access is the proprietary property of ACA and/or third parties from whom ACA has obtained rights to provide access to ACA's customers. You agree not to use this service except as authorized by this agreement and, in any event, not to make it available to any third parties. 3. You agree to immediately notify your ACA branch office if there is a discrepancy in the account balances or security positions available on Online Access. If unable to contact your local office contact the Louisiana Ag Credit ACA Administrative office in Arcadia (1-866-LAFARMS) or send your notification to: Louisiana Ag Credit ACA P. O. Box 478 Arcadia, La. 71001 If you fail to notify ACA of any such discrepancy, neither ACA nor any of its employees, affiliates, subsidiaries, or its parent, nor any third parties, can or will have any responsibility or liability to you or to any other person whose claim may arise through you for any claims with respect to such discrepancy. 4. You understand that ACA will not be responsible for the accuracy, completeness, or use of any information received by you from outside data sources through this service and that ACA does not make any warranty concerning such information. You agree that neither ACA nor any third party working with ACA to provide services hereunder shall be responsible for any damages caused by communications line failure, unauthorized access, theft, systems failure, and other occurrences beyond its control. You agree to provide all telephone and other equipment to access your account online, and you will be solely responsible for paying all charges related thereto. 5. You expressly acknowledge and agree that the use and storage of any information, including without limitation, portfolio information, transaction activity, account balances, and any other information available through use of Online Access is at your sole risk and responsibility. NEITHER ACA NOR ANY THIRD PARTY MAKES ANY REPRESENTATIONS OR WARRANTIES EXPRESS OR IMPLIED INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IN RESPECT OF ONLINE ACCESS OR ANY INFORMATION PROGRAMS OR PRODUCTS OBTAINED FROM, THROUGH, OR IN CONNECTION WITH ONLINE ACCESS. IN NO EVENT WILL ACA OR ANY THIRD PARTY BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY DEFECT IN OR USE OF THIS SERVICE. 6. You agree that ACA may discontinue your access to Online Access in whole or in part, at any time, and that ACA may modify or change the terms of it, in whole or in part, at any time and from time to time. You agree that ACA may immediately terminate its services if you breach this agreement or if you have jeopardized the proper and efficient operation of its services. 7. You agree that ACA shall not be under a duty to inquire as to the authority or propriety of any information or instructions given to ACA by you pursuant to the terms of this agreement, and ACA shall be entitled to act upon any such information or instructions, and ACA will not be liable for any loss, cost, expense or other liability arising out of any such instructions. You understand that telephone calls and other communications to ACA may be recorded, and you hereby consent to such recording. You agree that ACA may monitor, store and retrieve any electronic communication transmitted online. 8. ACA will take reasonable security precautions concerning the electronic transmission of data or communications, but ACA disclaims any liability for interception of any such data or communications. ACA shall not be responsible for, and makes no warranties regarding, the access, speed or availability of internet or network services. 9. You recognize that your use of Online Access will involve the transmission to you of personal financial information, including but not limited to the transaction, account balances and holdings in your account. You consent to the transmission by electronic means of such information through the internet, and such consent shall be effective at all times that you use the service. 10. In the event of any disruption in the availability of Online Access, contact your local ACA branch office for information on your account.
